מדיניות ההחזרות של "פוטון בר" (For English, please see the text below)

 פוטון בר (להלן "החנות") תאפשר החזרת מוצרים ותבצע החזר כספי לצרכן, בכל המקרים בהם הדבר מחויב על פי הדין, לרבות: 

1. כל מוצר, שהמחיר ששולם בעדו הוא מעל 50 ש“ח, שהוחזר באריזתו המקורית מבלי שנעשה בו שימוש, והמוצר לא נפגם - ובלבד שהמוצר הוחזר בהתאם לקבוע בתקנות הגנת הצרכן (ביטול עסקה) התשע“א – 2010 (במסמך זה ”התקנות“) תוך 14 יום ממועד קבלת המוצר. הכל בכפוף לאמור בסעיפים הבאים. 

2. החנות לא מאפשרת החזרת מוצרים שנעשה בהם שימוש או מוצרים שאריזתם נפתחה (לדוגמא – מיטה שהותקנה, מזרן שנעשה בו שימוש) או שנפגמו. החזרת מוצרים באריזתם המקורית שלא נפתחה תהווה ראיה מספקת לאי עשיית שימוש בהם. 

3. לחנות זכות לגביית דמי ביטול בסך 5% ממחיר המוצר או 100 ש“ח - לפי הנמוך, וכן זכות לגבות את התשלום ששולם על ידה לחברות סליקת כרטיסי אשראי או לגופים מתווכים אחרים בגין העסקה שבוטלה, והכול בכפוף להוראות כל דין. 

4. לא תתאפשר החזרת מוצרים שיוצרו במיוחד עבור הלקוח על פי מידות או דרישות מיוחדות  

5. בעסקת מכר מרחוק (כהגדרתה בחוק הגנת הצרכן, תשמ“א 1981) - רשאי הצרכן לבטל בכתב (לרבות בפקס או בתקשורת אלקטרונית) את העסקה, להחזיר את המוצר ולקבל החזר כספי, אם הודיע לחנות על ביטול העסקה כאמור עד תום 14 יום מיום קבלת המוצר (ובשירות - עד תום 14 יום מיום עשיית העסקה ובלבד שמועד ביטול השירות לא יאוחר מ – 2 ימים) שאינם ימי מנוחה (לפני המועד בו אמור השירות להינתן) או מיום קבלת מסמך פרטי העסקה כקבוע בדין (לפי המאוחר). גם זכות ביטול זו לא תחול על מוצרים שיוצרו במיוחד בעבור הלקוח בעקבות העסקה, ועל מוצרים שהלקוח פתח את אריזתם המקורית. 

6. זכות ביטול עסקה והחזר כספי כאשר העסקה נעשתה במסגרת מכירה מיוחדת (כהגדרתה בחוק הגנת הצרכן) או מבצע – מוגבלת בהתאם לקבוע בתנאי/תקנון המבצע או המכירה המיוחדת, ובלבד שאלו הוצגו בפני הלקוח, בכתב, במועד הרכישה, ובכפוף להוראות כל דין. 

7 .בכל מקרה שלגביו הדין מחייב את החנות לבצע החזר כספי, החנות תבצע החזר כספי בהתאם להוראות הדין. החנות איננה מתחייבת לאפשר החזרת מוצרים ולבצע החזר כספי או למסור שובר זיכוי במקרים בהם הדבר אינו מחויב על פי הדין.

8 .לחנות שיקול דעת לבצע החזר כספי או למסור ללקוח שובר זיכוי, במקרים הבאים: 

9. מוצר שהמחיר ששולם בעדו הנו 50 ש“ח או פחות, אשר לא נפתח ולא נעשה בו שימוש, אם החזרתו מתבקשת עד 14 יום ממועד הרכישה, ובלבד שהאריזה לא נפתחה ולא נקרעה. 

10. החנות רשאית לוותר על דמי הביטול שהיא זכאית להם על פי הדין, כולם או חלקם.

11. בכל מקרה של החזרת מוצר, יישא הלקוח במלוא עלויות ההובלה, לרבות הובלת המוצר אל החנות, ויהיה אחראי להשבתו כשהוא ארוז, מוגן ובמצבו המקורי כפי שנמסר לו.
לחנות שמורה הזכות הבלעדית לקבוע, על פי שיקול דעתה, האם נגרם נזק למוצר.
במקרה שבו יימצא כי נגרם נזק למוצר, יישא הלקוח במלוא עלות המוצר, וכן בכל עלות נוספת הנובעת מכך.

Futon-Barr Return Policy

Futon-Barr (hereinafter: “the Store”) shall allow the return of products and provide refunds to consumers in all cases required by law, including the following:

1. Any product with a purchase price exceeding 50 NIS, returned in its original packaging, unused and undamaged, provided that the return complies with the Consumer Protection Regulations (Cancellation of a Transaction), 2010 (hereinafter: “the Regulations”), and is made within 14 days from the date of receipt of the product, all subject to the provisions below.

2. The Store does not accept returns of products that have been used, whose packaging has been opened (for example: an assembled bed or a mattress that has been used), or that have been damaged. Returning a product in its original, unopened packaging shall constitute sufficient evidence that it has not been used.

3. The Store reserves the right to charge a cancellation fee of 5% of the product price or 100 NIS, whichever is lower, and to charge any fees incurred by the Store from credit card clearing companies or other intermediaries in connection with the cancelled transaction, all subject to applicable law.

4. Returns will not be accepted for products manufactured specifically for the customer according to custom measurements or special requirements.

5. In the case of a distance selling transaction (as defined in the Consumer Protection Law, 1981), the consumer may cancel the transaction in writing (including via fax or electronic communication), return the product, and receive a refund, provided that notice of cancellation is given within 14 days from the date of receipt of the product (and in the case of services - within 14 days from the date of the transaction, provided that cancellation occurs no later than two days, excluding rest days, before the service is to be provided), or from the date of receipt of the transaction details document as required by law (whichever is later). This right of cancellation shall not apply to products manufactured specifically for the customer or to products whose original packaging has been opened.

6. The right to cancel a transaction and receive a refund when the purchase was made במסגרת a special sale (as defined in the Consumer Protection Law) or promotion is subject to the terms of the specific promotion, provided that these were presented to the customer in writing at the time of purchase, and subject to applicable law.

7. In any case where the law requires the Store to issue a refund, the Store shall do so in accordance with the law. The Store does not undertake to allow returns, issue refunds, or provide store credit in cases where it is not legally obligated to do so.

8. The Store reserves the right, at its sole discretion, to issue a refund or provide store credit in the following cases:

9. A product priced at 50 NIS or less, provided it has not been opened or used, may be returned within 14 days from the date of purchase, provided that the packaging remains unopened and intact.

10. The Store may waive, in whole or in part, any cancellation fees to which it is entitled under the law.

11. In any case of product return, the customer shall bear the full cost of transportation, including delivery of the product back to the Store, and shall be responsible for returning the product properly packaged, protected, and in its original condition as received.
    The Store reserves the exclusive right, at its sole discretion, to determine whether the product has been damaged.
    If damage is found, the customer shall bear the full cost of the product, as well as any additional costs arising therefrom.
